Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the myBenkio website and services operated by myBenkio, including our learning platform, campaigns, referral programs, leaderboards, and other features.
1. Acceptance of Terms
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service. Your use of campaigns, referral programs, leaderboards, and other features is also subject to these Terms and any additional terms specific to those features.
2. Accounts
When you create an account with us, you must provide us information that is accurate, complete, and current at all times. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service. You may not create multiple accounts to circumvent campaign or referral program restrictions.
3. User-Generated Content
You retain ownership of content you submit to the Service (materials, questions, comments, flashcards). By submitting content, you grant myBenkio a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and distribute your content for the purpose of operating and improving the Service. You represent that you have the right to grant this license and that your content does not violate any third-party rights, including copyright, trademark, or privacy rights. We reserve the right to moderate, edit, or remove any user-generated content at our discretion.
4. Campaigns and Referral Programs
Participation in campaigns (referral, prize, event, ambassador, or special referral campaigns) is subject to eligibility requirements and campaign-specific rules. Referral codes are for personal use only and may not be sold, transferred, or used fraudulently. We reserve the right to disqualify participants, revoke rewards, or terminate campaign participation for violations, fraud, or abuse. Campaign rewards are subject to verification and may be delayed or denied if eligibility cannot be confirmed. Ambassador program participants must comply with program guidelines and may be terminated for violations.
5. Leaderboards
Leaderboard rankings are calculated based on various metrics (accuracy, quizzes completed, study time, streaks, points) and are updated in real-time or periodically. Rankings are determined by our algorithms and are final. We reserve the right to adjust rankings, remove users from leaderboards, or recalculate metrics if we detect fraud, abuse, or technical errors. Leaderboard participation may be displayed publicly unless you opt out in your privacy settings.
6. Intellectual Property
The Service and its original content, features and functionality are and will remain the exclusive property of myBenkio and its licensors. You may not copy, modify, distribute, sell, or lease any part of our Service or included software. You may not reverse engineer or attempt to extract the source code of our Service. All trademarks, service marks, and trade names are the property of their respective owners.
7. DMCA and Copyright
We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). If you believe your copyrighted work has been infringed, you may submit a DMCA takedown request. We will process valid DMCA requests and may remove infringing content. Users who repeatedly infringe copyrights may have their accounts terminated. 8. Prohibited Conduct
You agree not to: violate any laws or regulations, infringe on intellectual property rights, submit false or misleading information, engage in fraud or abuse, attempt to manipulate campaigns or leaderboards, interfere with the Service's operation, use automated systems to access the Service without permission, harass or harm other users, or use the Service for any illegal purpose. Violations may result in account termination and legal action.
9. Subscriptions and Payments
Subscription fees are charged in advance on a monthly or yearly basis. You are responsible for all charges incurred under your account. We reserve the right to change subscription prices with 30 days' notice. Refunds are subject to our Refund Policy. Failed payments may result in service suspension. You may cancel your subscription at any time, but refunds are only available within the refund period specified in our Refund Policy.
10. Disclaimers and Limitation of Liability
The Service is provided 'as is' without warranties of any kind. We do not guarantee accuracy, completeness, or availability of content. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim. Campaign rewards and prizes are provided 'as is' without warranties.
11. Termination
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms, engage in fraud or abuse, violate intellectual property rights, or engage in prohibited conduct. Upon termination, your right to use the Service will cease immediately, and we may delete your account and data subject to our data retention policy. Campaign rewards and referral earnings may be forfeited upon termination for cause.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.
